1. Acceptance of Terms
By accessing or using ZIAF POS's website or platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you're using the Service on behalf of an organization, you're agreeing on its behalf and confirming you have the authority to do so.
2. Accounts & Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You're responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3. Subscriptions & Billing
Paid plans are billed in advance on a monthly or annual basis. Fees are non-refundable except where required by law. We may change our pricing with at least 30 days' notice; continued use of the Service after a price change constitutes acceptance of the new pricing.
4. Acceptable Use
You agree not to misuse the Service, including but not limited to: attempting unauthorized access to any systems, transmitting malware, reverse-engineering the platform, or using the Service to violate any applicable law or third-party rights.
5. Intellectual Property
ZIAF POS and its licensors retain all right, title and interest in the Service, including all associated intellectual property rights. You retain ownership of any data you upload to the Service ("Customer Data"), and grant us a limited license to host and process it solely to provide the Service.
6. Third-Party Services
The Service may integrate with third-party applications (e.g. Slack, Stripe, Salesforce). Your use of those integrations is subject to the third party's own terms, and ZIAF POS is not responsible for their acts or omissions.
7. Termination
You may cancel your account at any time from your account settings. We may suspend or terminate your access if you materially breach these Terms and fail to cure the breach within a reasonable period after notice.
8. Disclaimers & Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, ZIAF POS will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service.
9. Indemnification
You agree to indemnify and hold ZIAF POS harmless from any claims, damages or expenses arising from your misuse of the Service or violation of these Terms.
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes will be resolved in the state or federal courts located in San Francisco County, California.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll provide notice through the Service or by email prior to the changes taking effect.
